State Intellectual Property Office proposes to clarify that AI systems cannot be inventors and that inventors named in patent documents must be natural persons
1AI learned from the official website of the State Intellectual Property Office (SIPO) that the Guidelines for Patent Applications for Artificial Intelligence-Related Inventions (Draft for Public Comments) was published for public comment on December 6th. The Guidelines make it clear that for inventions generated by AI, AI inventor status cannot be granted in the current legal context of China. The Exposure Draft mentions that for AI-assisted inventions and AI-generated inventions, AI tools or systems are involved to varying degrees in the process of generating the invention.
